FAMILY LAW FINANCIAL RELIEF

Maintenance Legal Assistance in Chennai

Maintenance law is intended to provide financial support where a legally entitled spouse, child, parent or other claimant is unable to adequately maintain himself or herself in the circumstances recognised by law.

Maintenance can arise in different proceedings and under different statutes. Depending upon the facts, a claim may involve monthly maintenance, interim maintenance during the pendency of proceedings, litigation expenses, permanent alimony, child maintenance or recovery of unpaid arrears.

There is no single fixed maintenance amount applicable to every case. Courts ordinarily examine the financial position of the parties, income, liabilities, standard of living, dependants, needs of children and other relevant circumstances.

Interim maintenance and final maintenance are different

Interim maintenance is generally intended to provide financial support while litigation is pending, whereas final maintenance or permanent alimony may be determined at the conclusion of the matrimonial proceeding or under the applicable statute.

TYPES OF FINANCIAL RELIEF

Maintenance and Interim Maintenance

The type of financial relief depends upon the proceeding, governing statute and stage of the case.

01

Interim Maintenance

Temporary financial support may be sought while matrimonial or family proceedings remain pending before the court.

02

Maintenance Pendente Lite

In matrimonial proceedings, a spouse without sufficient independent income may seek financial support during the pendency of the litigation where the governing law permits.

03

Litigation Expenses

Certain matrimonial provisions permit the court to award reasonable expenses necessary for conducting the proceeding.

04

Permanent Alimony

At the appropriate stage, a court may consider permanent financial relief, either periodically or as a lump sum, subject to the governing law and facts.

05

Child Maintenance

Children's food, education, medical care, accommodation and other reasonable needs may form part of maintenance proceedings.

06

Maintenance Arrears

Where an existing maintenance order is not complied with, appropriate enforcement or recovery proceedings may be considered.

IMPORTANT LEGAL PROVISIONS

Maintenance Remedies Under Different Laws

The correct provision depends upon the relationship, matrimonial proceeding and relief sought.

SECTION 144 BNSS

General Maintenance Remedy

Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 contains the general statutory maintenance framework corresponding to the earlier Section 125 CrPC remedy. It may apply to eligible wives, children and parents, subject to statutory requirements.

SECTION 24 HINDU MARRIAGE ACT

Interim Maintenance & Litigation Expenses

Section 24 of the Hindu Marriage Act permits either spouse, where the statutory conditions are satisfied, to seek maintenance pendente lite and expenses of proceedings.

SECTION 25 HINDU MARRIAGE ACT

Permanent Alimony & Maintenance

Section 25 empowers the matrimonial court to consider permanent alimony and maintenance in accordance with the statutory requirements and circumstances of the parties.

SECTION 20 DV ACT

Monetary Relief

Section 20 of the Protection of Women from Domestic Violence Act, 2005 provides for monetary relief in appropriate domestic violence proceedings, including specified financial losses and maintenance-related relief.

UNDERSTANDING THE DIFFERENCE

Interim Maintenance vs. Permanent Maintenance

DURING THE CASE

Interim Maintenance

Interim maintenance is ordinarily intended to provide support during the pendency of the proceeding so that an eligible party can meet reasonable living expenses and participate in litigation.

  • Operates during pendency of proceedings
  • May include litigation expenses
  • Based on prima facie financial material
  • Can be modified where circumstances legally justify it
  • Does not necessarily determine final maintenance
FINAL FINANCIAL RELIEF

Permanent Maintenance / Alimony

Permanent financial relief is considered at the appropriate stage under the governing statute and may be structured as periodical payments or a lump-sum amount.

  • Income and property considered
  • Conduct and circumstances may be relevant under applicable law
  • Needs and liabilities considered
  • Children and dependants may affect financial capacity
  • Subsequent change in circumstances may have legal consequences
ASSESSMENT OF MAINTENANCE

How Does the Court Decide the Amount?

Maintenance is not calculated by applying one universal percentage. The court considers the circumstances proved in the particular case.

1

Income of Both Parties

Salary, business income, professional income, rental income and other established sources may be examined.

2

Standard of Living

The standard of living enjoyed during the subsistence of the matrimonial relationship may be relevant.

3

Reasonable Monthly Needs

Food, accommodation, utilities, transport, medical expenses and other reasonable needs are considered.

4

Children's Expenses

School fees, tuition, medical expenses and other child-related costs may significantly affect the assessment.

5

Liabilities & Dependants

Genuine liabilities and responsibility towards other legally dependent family members may be relevant.

6

Assets & Financial Capacity

Property, investments, bank transactions and overall financial capacity may be examined where relevant.

7

Employment & Qualifications

Actual income is important. Educational qualification or earning capacity may be relevant but does not automatically replace proof of real financial circumstances.

8

Existing Maintenance Orders

Existing orders under another proceeding should be disclosed so that overlapping financial relief can be appropriately considered.

FINANCIAL DISCLOSURE

Income Documents Are Important

Maintenance Cases Require Clear Financial Disclosure

Courts may require parties to place detailed financial information and supporting records on file. Salary statements, income-tax records, bank statements, business records, loan liabilities, property details and children's expenses can become important in determining a fair maintenance amount.

Incomplete disclosure, concealment of income or unsupported financial allegations can materially affect the court's assessment.

CHILDREN

Child Maintenance and Educational Expenses

Financial responsibility towards children is distinct from the personal dispute between husband and wife.

01

School Fees

Tuition fees, school fees and reasonable educational expenditure may form part of the child's financial needs.

02

Medical Expenses

Regular healthcare, insurance and exceptional medical expenses may be relevant to the maintenance assessment.

03

Daily Living Expenses

Food, clothing, accommodation, transportation and other reasonable day-to-day expenses are relevant.

RESPONDING TO MAINTENANCE CLAIMS

Can a Maintenance Claim Be Contested?

Yes. A respondent may place legally relevant facts and financial material before the court.

The Court Should Have the Complete Financial Picture

A maintenance proceeding does not require the respondent to accept every amount claimed. The respondent may place before the court his or her actual income, liabilities, existing dependants, payments already made and other legally relevant circumstances.

At the same time, deliberately suppressing income or attempting to defeat a lawful maintenance claim can adversely affect the case.

Relevant defence material may include:

Salary statements, bank records, loan documents, proof of payments already made, medical liabilities, dependant details, existing maintenance orders and material concerning the claimant's actual income, where legally relevant.

Maintenance Defence Review

  • Actual Monthly Income
  • Salary Deductions
  • Genuine Loan Liabilities
  • Dependent Parents
  • Existing Child Expenses
  • Amounts Already Paid
  • Claimant's Established Income
  • Existing Maintenance Orders
NON-PAYMENT OF ORDERED MAINTENANCE

Recovery of Maintenance Arrears

An order of maintenance is not merely advisory. Failure to comply may lead to enforcement proceedings under the applicable law.

Existing Maintenance Orders Can Be Enforced

Where a party fails to pay maintenance ordered by the court, the person entitled to receive maintenance may consider the appropriate execution, recovery or statutory enforcement procedure depending upon the nature of the original order.

The applicable limitation, arrears period, method of recovery and enforcement powers depend upon the provision under which the maintenance order was passed.

CASE PROCESS

General Maintenance Case Procedure

Procedure varies according to the statute and court, but the following stages commonly arise.

01

Case Assessment

Marriage or family relationship, existing cases, income, expenses and financial needs are reviewed.

02

Select Appropriate Provision

The appropriate statutory remedy is identified based upon the relationship and pending matrimonial proceedings.

03

Petition / Application Filed

The maintenance claim or interim application is filed before the competent court with relevant pleadings and documents.

04

Financial Disclosure

Parties may be required to disclose income, assets, liabilities and supporting documents.

05

Arguments / Evidence

The court considers the financial material, needs of the claimant and capacity of the respondent.

06

Maintenance Order

The court determines the amount and terms of payment according to the applicable law and circumstances.

FREQUENTLY ASKED QUESTIONS

Maintenance & Interim Maintenance FAQs

What is interim maintenance?

Interim maintenance is temporary financial support granted during the pendency of a matrimonial or family proceeding, subject to the governing statutory provision and facts.

What is the difference between interim maintenance and permanent alimony?

Interim maintenance generally operates while proceedings are pending. Permanent alimony or final maintenance is considered at the appropriate stage under the applicable statute and may continue after final adjudication.

Can a husband claim interim maintenance?

Under provisions such as Section 24 of the Hindu Marriage Act, either spouse may seek maintenance pendente lite if the statutory requirements concerning insufficient independent income are satisfied.

Which provision replaced Section 125 CrPC?

The general maintenance provision is now contained in Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, corresponding to the earlier Section 125 CrPC framework.

Is there a fixed percentage of salary for maintenance?

No single percentage mechanically applies to every case. Courts examine the income, needs, liabilities, standard of living, children and other relevant circumstances of the parties.

Can an employed wife claim maintenance?

Employment by itself does not automatically determine the issue. The court examines actual income, sufficiency of that income, standard of living, needs and the circumstances under the applicable statutory provision.

Can child maintenance be claimed separately?

Yes. Children's maintenance and reasonable educational, medical and living expenses may be considered separately or as part of appropriate family-law proceedings.

What if the husband hides his income?

The claimant may place available financial material and circumstances before the court. Courts may examine bank records, employment details, tax records, lifestyle evidence and other legally admissible material where relevant.

Can maintenance be increased later?

Depending upon the governing provision, a material change in circumstances may permit an application for alteration or modification of the maintenance amount.

What can be done if maintenance is not paid?

Where an enforceable maintenance order is not complied with, appropriate recovery or execution proceedings may be initiated under the provision governing the original order.

Can maintenance be claimed in more than one proceeding?

Different statutory proceedings may provide financial remedies, but existing orders and amounts received must ordinarily be disclosed. The court may take overlapping relief into account to avoid unjust duplication.

How long does an interim maintenance application take?

There is no guaranteed fixed period applicable to every case. The time depends upon service, filing of counters, financial disclosure, court schedule and complexity of the dispute.
